Kangana Ranaut, also a politician, has reacted to the order passed by the Bombay High Court in connection with the delay in CBFC clearing her upcoming release Emergency. Kangana, while reacting to the order from the BHC She expressed her views thus:
“High court has blasted censor for illegally withholding the certificate of emergency.” The Central Board of Film Certification (CBFC) was asked to consider objections to the film before granting certification but the court refused to give any directions related to the issue, PTI reported. This is despite an order of the Madhya Pradesh High Court which had directed the CBFC to do so.
What happened regarding the Emergency?
The film was earlier scheduled for a September 6 release; now it is postponed by two weeks from that date. The latest release date is 8th September. It is believed that the Supreme Court has passed an order to the Censor Board to ask them to consider the objections submitted on the picture and thereafter certify it by 18th September. Due to this reason, all this has come to pass. An application was filed before the Bombay High Court by Zee Entertainment Enterprises, a production of the said film, praying for a direction to be issued to the Central Board of Film Certification (CBFC) regarding granting a certificate to the biopic Emergency.
What did BHC say in response to that?
A division bench comprising Justices B P Colabawalla and Firdosh Pooniwalla, on Wednesday granted credence to the contention of the producer that though available, the certificate was not provided. The producer claimed so. The charge which the producer had levelled was accepted.
The bench, after the certificate was issued online to the respondents who were concerned with the production of the film, held that the reasons adduced by the CBFC that it has not sent the certificate because it is not signed by the chairperson, was incorrect. “The reason cites that the certificate was not issued after it was issued online,” it said. Having said so, the court made it very clear that it would have passed an order to the Central Board of Financial Control to grant the certificate on Wednesday itself had it not been for the fact that the Madhya Pradesh High Court has passed an order, which it said in no uncertain terms.
While concurring with the view of the petitioner in respect of the case, the Bombay High Court held that it would not be able to grant any relief in view of the judgment pronounced by the High Court of Madhya Pradesh. This was because it was the Madhya Pradesh High Court that issued the ruling in the first instance. This was told by the plaintiff when the case came up for hearing on Wednesday before Zee Entertainment.
Kangana is the release director of this upcoming biographical drama, which is scheduled to release on September 6. Presently, it is in the middle of a controversy because of the objections raised by organizations such as Shiromani Akali Dal. This is an after-effect of the complaints which were aired against it. Various organizations accused it of misrepresenting the community and not knowing historical facts. Apart from that, they have stated that it is not correct.
